Application of Hindu Inheritance Law in British India and Its Consequences on Capital

Abstract

Hindu inheritance law was implemented in British India. This paper will look at the Mitakshara and Dayabagha doctrines and examine their respective impact on capital in India. We will show how the Mitakshara may have been more favorable for capital accumulation than the Dayabagha. The social and economic effects of this difference will be discussed. Evidence will be provided from legal cases from the High Courts of British India.
